Terms of service
These terms are the agreement between your business and RetestLog. They explain what you get, what you pay, and what each of us is responsible for.
The short version
- Start with a free trial. Depending on the offer, you add a payment method when you start or when the trial ends.
- Subscriptions renew automatically until you cancel. Cancel before a trial ends and you are not charged.
- Your shop owns its records. Saved records are never changed; corrections are added as amendments.
- RetestLog helps you keep complete records. It does not make your shop compliant. Your shop stays responsible for its NFPA (National Fire Protection Association) 10, licensing and other regulatory duties.
1. Who we are and who these terms cover
RetestLog is provided by RetestLog LLC (“RetestLog”, “we”, “us”).
These terms are between us and the business that registers (“your shop”, “you”). The person who accepts them confirms that they may agree to them for the shop. RetestLog is for business use only.
The people your shop invites to RetestLog must follow these terms too, and your shop is responsible for them. Our privacy policy explains how we handle personal information.
2. What RetestLog is
RetestLog is software, used in a web browser, that keeps a fire extinguisher service company’s NFPA 10 service records, checks entries as they are made, and lists what is coming due.
RetestLog is not affiliated with, approved by or endorsed by the NFPA, any fire marshal’s office or any other government agency. RetestLog does not file anything with any agency or anyone else.
3. Your shop stays responsible for compliance
This is the most important part of these terms.
- Your shop is the service company. It is responsible for its inspections, services and tests, its tags and labels, its records and its compliance with the NFPA 10 edition its state or city has adopted, with its state’s licensing rules, and with any other rule that applies to it.
- RetestLog helps keep your records complete. It does not guarantee regulatory compliance. RetestLog does not perform, certify or approve any inspection, service or test.
- RetestLog checks entries against our reading of the rules and shows the section for each rule. Our reading can be wrong, incomplete or out of date, and rules change. Check the rules against the current regulation and your adopted NFPA 10 edition.
- We do not promise that you will pass an inspection or avoid fines.
- Keeping records for as long as the rules require is your shop’s duty, including after you stop using RetestLog. See section 8.
4. Records are permanent
RetestLog keeps your compliance records as a permanent history. Once a record is saved, it is not changed. To correct a record, you add an amendment, and the original stays visible with it. A record entered in error can be voided, and the void is kept with it. Each record keeps the name and qualifications of the person who made it, as they were at the time, even after that person leaves your shop.
5. Accounts and security
- Sign-in. People sign in with the methods RetestLog offers, such as a third-party account or a one-time code we email them.
- One person, one sign-in. Each person signs in as themselves. Do not share sign-ins.
- Admins. Your shop’s admins invite people, give them roles and remove them. Keep the email accounts your admins sign in with secure, and turn on multi-factor authentication where your provider offers it.
- Remove people who leave. Your shop decides who has access and is responsible for removing people who leave.
- At least one admin. Your shop always keeps at least one admin. If your shop loses its only admin, contact us. We will check identity before we restore access, which takes time.
- Your account, your responsibility. Your shop is responsible for what happens under its account. Tell us at once if you think someone has got in without permission.
6. Free trial, subscription and payment
- Free trial. A new shop may start with a free trial. The trial’s length, and whether you add a payment method when you start or later, are shown when you register. One free trial per shop. We may change or end free-trial offers for new shops at any time.
- If you added a payment method when you started, your subscription starts automatically when the trial ends, and we charge your payment method then, unless you cancel before the trial ends.
- If you did not, add a payment method and start a subscription to keep using RetestLog after the trial. Until you do, your shop’s account is locked: no one can sign in to it. We keep your shop’s data while it is locked, as section 8 explains.
- Prices. Prices and plans are shown on our website or in the app. You pay the price shown when you subscribe. Prices do not include taxes unless we say so.
- Automatic renewal. Your subscription renews automatically at the end of each billing period, at the then-current price, until you cancel. We charge your payment method at the start of each period.
- Payment processor. Payments are handled by a third-party payment processor. We do not store your full card number. The processor’s terms may also apply to your payment.
- Taxes. You pay any sales, use or similar taxes that apply to your subscription. We collect them where the law requires.
- Price changes. We will tell your shop’s admins by email at least 30 days before a new price applies to your subscription. If you do not want the new price, cancel before it applies.
- Failed payments. If a payment fails, we may try again. If it remains unpaid, we may suspend or lock your shop’s account until it is paid, and end the subscription if it stays unpaid.
7. Cancelling and refunds
- Cancel anytime by emailing us. Cancelling stops the next renewal.
- During a free trial, cancel before the trial ends and you are not charged.
- Your access continues to the end of the billing period you have paid for. We do not give prorated or partial refunds.
- Nothing in these terms takes away a refund the law requires.
8. Your data
- You own your shop’s data: its equipment and service records, credentials, attachments, and your customers’ details. You give us permission to host, process, copy and show it to provide, secure and support RetestLog. We do not sell it.
- Your customers’ information. Your shop decides what it records about its own customers and is responsible for having the right to record it and to have us send them messages for you. We process it for you, as our privacy policy explains.
- Usage data and statistics. We collect information about how RetestLog is used, and we may use it to run, improve and market RetestLog. We may also create de-identified or aggregated data that does not identify your shop or any person, and use it for any purpose.
- Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.
- Taking your records with you. You can print or download the reports RetestLog offers, such as service reports and the list of what is coming due. We do not promise a full export.
- When your subscription ends or your account is locked. We keep your shop’s data for a reasonable period so you can return and pick up where you left off. After that, we may delete it. Deleted data may remain in backups until they expire.
- Your retention duty. You must keep your records for as long as the rules require, even after you leave RetestLog. Do not rely on us to keep them for you after your subscription ends. If you ask us to delete records, we may remind you of that duty before we do.
9. Acceptable use
Do not use RetestLog to:
- break the law, or record inspections, services or tests that did not happen, or results that are false;
- reach another shop’s data, or try to;
- test, probe or get around our security, or overload the service;
- copy, scrape, resell or rent out RetestLog, reverse engineer it, or build a competing product from it;
- upload malware, or content you have no right to upload;
- send spam or messages people have not agreed to receive.
10. The service
- We work to keep RetestLog available, but we do not promise it will always be available or free of errors.
- We may take RetestLog offline for maintenance, and try to do so outside working hours.
- We may change, add or remove features. If we remove a major feature your shop relies on, we will tell you first.
- RetestLog relies on third-party services, such as hosting, sign-in, email and payment providers. We are not responsible for their services.
11. Support
Email us or use the contact form. We reply by email, usually within one business day (Mon-Fri, Pacific). We may use AI tools to help us answer.
12. Suspension and termination
- Non-payment. We may suspend or lock an unpaid account, as section 6 explains.
- Breaking these terms. We may suspend or close an account that breaks these terms or puts other shops or the service at risk. Where we reasonably can, we will tell you why and give you a chance to fix it first.
- If we stop offering RetestLog, we will give at least 60 days’ notice and refund any prepaid fees for the time after it stops.
13. No warranties
RetestLog is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that RetestLog is error-free, that its rule checks are complete or current, or that using it makes your shop compliant.
14. Limits on our liability
To the extent the law allows:
- We are not liable for indirect, incidental, special or consequential losses, lost profits or revenue, lost data, or fines and penalties imposed on your shop.
- Our total liability for all claims about RetestLog is limited to the greater of the fees your shop paid us in the 12 months before the claim, or $100.
These limits do not apply where the law does not allow them to.
15. Indemnity
Your shop will defend and pay for claims brought against us by others that arise from your shop’s work, records or compliance, the information your shop records about others or asks us to send them, or your shop’s breach of these terms.
16. Governing law and disputes
Washington State law governs these terms. Before starting a legal claim, contact us and give us 30 days to try to settle it. Any legal claim goes to the state or federal courts in Washington, and both of us agree to those courts.
17. Changes to these terms
We may change these terms. We will post the new version here with a new “Last updated” date. For a material change, we will email your shop’s admins at least 30 days before it takes effect. If you keep using RetestLog after that, the new terms apply. If you do not agree, cancel before they take effect.
18. General
- These terms and the privacy policy are the whole agreement between us about RetestLog.
- We may transfer these terms to an affiliate or to a buyer of RetestLog. You may not transfer them without our written agreement.
- If a court finds part of these terms unenforceable, the rest still applies.
- If we do not enforce a term right away, we can still enforce it later.
- Neither of us is responsible for delays caused by events outside our reasonable control.
- We send notices by email to your shop’s admins or in the app. You send notices to us by email.
